In Donovan v. State Farm Mutual Automobile Insurance Company, the Supreme Court of Pennsylvania, enlarged the rights of motor vehicle accident victims. Corey Donovan sustained serious injuries while riding his motorcycle. He then made claim for recovery of underinsured motorist benefits under his mother’s auto policy. State Farm denied the claim since the motorcycle was not insured under the mother’s policy. The Supreme Court ruled that the disclaimer was invalid finding that Corey Donovan was entitled to the $100,000.00 limit of coverage under his mother’s policy. This decision affects hundreds of motor vehicle accident victims in the state. This case was handled by James C. Haggerty, Esquire of HGSK.
