The Coverage Dispute
The case concerned automobile insurance policies providing unstacked UM/UIM coverage where additional vehicles were later added to the policies by endorsement. The litigation challenged the insurer’s failure to obtain new stacking waivers following the addition of those vehicles, as required by Pennsylvania’s Motor Vehicle Financial Responsibility Law.
How the Case Was Resolved
The coverage issue was novel and vigorously contested. Following extensive litigation and motion practice, the case was resolved through a class-wide settlement providing more than $12.6 million in relief to affected Pennsylvania policyholders.
