HGSK Injury Lawyers Files Class Action Against Progressive Over Denied Auto Insurance Claims

Despite this established precedent, Progressive, he explained, sought to bypass the ruling by reframing a household exclusion as a “regular use” exclusion, a tactic that, in HGSK’s view, unfairly denies policyholders their rightful benefits.

“The Pennsylvania Supreme Court made clear in Gallagher v. GEICO that exclusions attempting to bar stacked UM/UIM recovery between household policies are void and unenforceable. Fully aware of this, Progressive nonetheless attempted to recast an unenforceable household exclusion as a regular use exclusion in a disingenuous effort to create a defense where none exists and to deter [our client] from pursuing her uninsured motorist claim.”
