On October 7, 2014 James C. Haggerty, Esquire presented Oral Arguments to the Superior Court of Pennsylvania. This case involved an appeal from a Judgment entered against the plaintiff by the trial court. HGSK represented Teresa O’Brien on the appeal after trial. At the time of trial, the lawyer representing the defendant, hired by the insurance company, initially agreed to stipulate that the accident was the fault of the defendant.
At the start of trial, the lawyer hired by the insurance company withdrew the agreement. The case proceeded to trial and the jury determined that the accident was not the fault of the defendant, even though the defendant lost control of his vehicle, crossed the center line and struck the plaintiff, Teresa O’Brien. HGSK undertook representation of the plaintiff, Teresa O’Brien, on appeal in order to right the wrong which had occurred at trial. The issue remains pending before the Superior Court of Pennsylvania.
