What Is Dram Shop Liability?
The Pennsylvania Dram Shop Act provides in part that a business entity
which sells or furnishes alcoholic beverages to a visibly intoxicated
customer may be liable when that customer subsequently causes injury or
death to himself or another individual. For example, if a bar serves alcohol
to a visibly intoxicated customer who then attempts to drive home and causes a
motor vehicle accident with another individual, the owner of the establishment that served the
customer may be liable for injuries sustained by the other individual.
The law applies to bars, restaurants, liquor stores, social clubs, and
sponsors of events where alcoholic beverages are served.
Signs of “visible intoxication” include:
- Slurred or loud speech
- Ordering multiple rounds of drinks
- Crude or inappropriate behavior
- Falling asleep
- Red or watery eyes
