James C. Haggerty

Partner

Jim Haggerty is recognized as one of the preeminent personal injury, insurance coverage and bad faith attorneys in Pennsylvania. For over 30 years, he was the “go to guy” of many major property and casualty insurers for large and difficult cases. He was a leader of the defense bar, serving as the president of the Defense Institute and Chairman of its Motor Vehicle Law Committee. He now brings this knowledge and exposure to the representation of injured victims throughout the state. In 2012, he decided to change his career path and use his knowledge and skills for the benefit of claimants and victims. He brings his wealth of knowledge and experience to the firm to each case he handles on behalf of individuals against insurance companies.

Jim Haggerty has been recognized as a Super Lawyer each year since the inception of that honor. In addition he has been recognized as one of the Top 100 Lawyers in Pennsylvania and the Top 100 Lawyers in Philadelphia for each year from 2006 to the present. In fact, in 2007, he was recognized as one of the Top 10 Lawyers in Pennsylvania. He has been counsel in many important insurance law cases and has argued many matters of first impression before the state’s highest courts. Jim has authorized many articles and testified before legislative committees. Haggerty, Goldberg, Schleifer & Kupersmith, P.C. are proud to have such a dedicated and knowledgeable lawyer as one of our four founders.

His areas of practice include insurance coverage disputes, bad faith claims, uninsured and underinsured motorist claims and motor vehicle accidents. Jim Haggerty brings his wealth of experience and vast knowledge of the law to the representation of injured plaintiffs and accident victims. He is familiar with how insurance companies operate to keep injured victims from all damages they deserve. If you have been injured, he can help you obtain full recovery from the insurance company.

If you have been injured through negligence, he can help you seek the due negligence you need by filing an injury claim against the at-fault party’s insurance company.

Legal Matters Resolved

Jim Haggerty recently favorably resolved an underinsured motorist claim on behalf of the HGSK client. The client, while a student at Penn State, suffered a bimalleolar fracture of the ankle when struck by a car while crossing a street at 2:00 a.m. The underinsured motorist insurer contended that the accident was caused by the HGSK client. We conducted discovery, hired appropriate experts and established that liability rested with the operator of the striking vehicle. We also forced the hand of the insurance company, requiring that their claim representatives be made available for statements as to why they had not paid the claim. Shortly before their statements were to be taken, the insurance company paid the amount demanded by HGSK on behalf of its client. HGSK goes the extra mile to represent its clients against insurance companies for their personal injury claims.

*****

Jim Haggerty of HGSK was recently contacted by another attorney who was pursuing an underinsured motorist and bad faith claim against an insurance company. He requested the assistance of Jim Haggerty who is recognized throughout the state as an expert in these areas of law. Shortly after Jim Haggerty entered his appearance, the attorney for the insurance company contacted him advising that the insurance company was "concerned and scared" about the case now that he had entered his appearance on behalf of the plaintiff. Within days, the insurance company, which had offered zero before Jim Haggerty entered his appearance in the case, tendered its $100,000.00 policy limit in settlement of all claims. HGSK continues to effectively represent injured victims against insurers throughout the state.

*****

The Supreme Court of Pennsylvania recently issued its decision in AAA Mid-Atlantic Insurance Company v. Ryan, a case in which Jim Haggerty had filed an Amicus Curiae Brief on behalf of the Pennsylvania Association for Justice. The Pennsylvania Association for Justice is an organization of trial attorneys in the Commonwealth of Pennsylvania devoted to representing the interests of victims and the fair administration of justice throughout the state. In that case, the Supreme Court held that a motor vehicle accident victim was not entitled to duplicate payments for the same elements of loss once fully compensated for injuries sustained in the accident. The Supreme Court further held that any recoverable underinsured motorist benefits were to be offset by recovery from any tortfeasors.
